Terms of Service

These Terms of Service ("Terms") govern your access to and use of OneShot Headshot (the "Service"), operated by Jose Silva III ("OneShot," "we," "us," or "our"). By creating an account, purchasing credits, or otherwise using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. The Service

OneShot Headshot allows users to upload photographs and use artificial intelligence ("AI") technology to generate professional-style headshots and other images.

AI-generated results are created automatically and may contain inaccuracies, distortions, artifacts, or other unintended characteristics. We do not guarantee that generated images will accurately reproduce your appearance or meet your particular expectations.

We may modify, suspend, or discontinue portions of the Service at any time.

2. Eligibility and accounts

You must be legally capable of entering into a binding agreement to use the Service. You are responsible for maintaining the security of your account credentials and for activity occurring through your account.

You agree to provide accurate information when creating an account and to notify us if you believe your account has been accessed without authorization.

3. Uploaded photos and acceptable use

You may upload a photograph only if:

  • you are the person depicted in the photograph; or
  • you have obtained the necessary permission and legal rights to upload and process the photograph.

You may not upload photographs that:

  • depict anyone under 18 years of age;
  • violate another person's privacy, publicity, intellectual-property, or other legal rights;
  • are unlawful, fraudulent, defamatory, or otherwise prohibited by law;
  • are intended to impersonate, deceive, defraud, harass, or harm another person; or
  • contain content that violates our reasonable content or safety requirements.

You may not use the Service to attempt to circumvent security measures, interfere with the Service, introduce malicious code, scrape or systematically collect data from the Service, reverse engineer the Service except where such restriction is prohibited by applicable law, or otherwise abuse the Service.

We may refuse to process an upload or generation that we reasonably believe violates these Terms or presents a security, legal, or abuse risk.

4. Your content

You retain your ownership rights in photographs that you upload. You grant OneShot a limited, non-exclusive license to host, transmit, reproduce, modify, and otherwise process your uploaded photographs solely as reasonably necessary to operate, maintain, secure, and provide the Service to you.

This may include transmitting photographs to third-party technology and AI providers that process information on our behalf.

We do not claim ownership of your uploaded photographs.

We do not use your uploaded photographs or generated images to train our own or third-party AI models.

We will handle photographs and other personal information as described in our Privacy Policy.

5. Generated images

Subject to your compliance with these Terms and to the extent permitted by applicable law, we grant you our rights, if any, in the generated images created for you through the Service.

Because AI-generated content may not qualify for copyright protection in all circumstances, we do not guarantee that you will obtain copyright or other intellectual-property rights in any particular generated image.

You are responsible for determining whether your intended use of a generated image complies with applicable law and the rights of others.

6. Credits and payments

The Service may provide new accounts with one complimentary generation or other promotional credits.

Additional generations may require the purchase of credits at the prices displayed at the time of purchase.

Credits are generally non-transferable and may not be redeemed for cash.

If a generation fails because of a technical error attributable to OneShot, we will restore the applicable credit or complimentary generation.

Except where required by applicable law, purchases of credits are non-refundable.

We reserve the right to correct pricing errors and to refuse or cancel transactions resulting from obvious pricing or technical errors.

7. No professional or guaranteed result

The Service is intended to create professional-style images for personal and professional use. We do not guarantee that a generated image will be suitable for a particular employer, application, identification document, professional license, government filing, or other specific purpose.

You are responsible for reviewing generated images before using them.

8. Privacy

Our collection, use, storage, disclosure, and deletion of personal information are described in our Privacy Policy.

By using the Service, you acknowledge that photographs and other information you provide may be processed by OneShot and by third-party service providers acting on our behalf as necessary to provide the Service.

9. Third-party services

The Service may rely on third-party providers for functions such as AI image processing, cloud storage, authentication, analytics, payment processing, and infrastructure.

We are not responsible for the independent acts or omissions of third-party services, although we will take reasonable steps to select and manage service providers appropriate to the operation of the Service.

10. Intellectual property

The Service, including its software, design, branding, text, graphics, and other materials provided by OneShot, is owned by or licensed to OneShot and is protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, or create derivative works from the Service or its underlying technology.

11. Suspension and termination

You may stop using the Service at any time.

We may suspend or terminate your access to the Service if we reasonably believe that you have violated these Terms, engaged in fraud or abuse, created a security risk, or used the Service unlawfully.

We may also suspend or terminate accounts when reasonably necessary to protect the Service, our users, or third parties.

Upon termination, provisions that by their nature should survive termination—including provisions concerning intellectual property, limitations of liability, and dispute-related matters—will remain effective.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available."

We do not warrant that the Service will be uninterrupted, error-free, secure, or available at all times, or that generated images will meet your expectations or be accurate, complete, or suitable for a particular purpose.

Nothing in these Terms disclaims a warranty or right that cannot lawfully be disclaimed under applicable law.

13. Limitation of liability

To the maximum extent permitted by applicable law, OneShot and its owners, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service.

To the maximum extent permitted by applicable law, our total liability for claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to OneShot for the Service during the 12 months before the event giving rise to the claim or (b) $100.

Nothing in these Terms limits liability or remedies to the extent such limitation is prohibited by applicable law.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless OneShot and its officers, employees, and contractors from claims, damages, liabilities, and expenses arising out of your unlawful use of the Service, your violation of these Terms, or your violation of another person's rights.

15. Changes to these Terms

We may update these Terms from time to time as the Service or applicable law changes.

If we make material changes, we will provide reasonable notice, such as by posting the updated Terms on the Service or notifying you by email.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

16. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles, except to the extent federal law or another mandatory applicable law provides otherwise.

Any dispute-resolution provision in these Terms is subject to applicable federal and Maryland law.

17. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
